Dirty Little Secrets

A failure in enforcing anti corrupt practices has been uncovered and settled with a 2 Million dollars fine.
In the period 2005-2007, Oracle India Private Ltd used secret cash cushions and fake invoices that made bribery possible.
We still urge the company to move towards a more citizen approach and publish detailled accounts in each of its operating subsidiaries.

Who's insuring we do not conduct unauthorized operations there ?

Comporate Transparency Issues (Season 3)

As a followup to the previous post, why would a fully compliant company, strictly implementing business rules according to the Oracle Ethics & Business Conduct code would need subsidiaries in the Cayman Islands ?
Why do we still maintain some black holes within a company, except for hiding things ?
After so many failures from the Audit companies (Olympus scandal, Wikipedia links, big four flaws), how can we truly be confident that massive financial manipulations are a thing of the past.

Can a shareholder assess the effectiveness of the internal whisleblowing processes ?
Can the world governments be so blind about the big corporations good reporting faith ?

Comporate Transparency Issues (Season 3)

What has changed since the Foreign Corrupt Practices Act in our big corporations ?
A huge number of employees are made aware of very strict rules of engagement, defined in the business ethics guide.
However, which body controls the whisleblowing process ?
What proof is been made that no black things is still been done under covert ?
Why isn't there any employee representatives in those governance bodies ?

Oracle's Africa dealings come under FBI scrutiny

We had the opportunity to report many times the company lack of transparency regarding Oracle tax haven operations, in capability to host many secret fund transfers towards swiss accounts.
CFDT Labor Union filled an official complaint regarding Oracle Ethics Code and the lack of compliance of Offshore operations.

The complaint was dismissed without further investigations.

The wall street journal is reporting an FBI investigation towards Oracle African deals, initiated few years ago, that could unveil many very unethics affairs, if the Tax havens operations secrecy could be blown out.

How many times shall we wait before state of art accounting, independant certification and operations transparency is enforced in subsidiaries like Cayman Islands ?

When are we really going to shut down these darn tax haven ?

You will find very few Electronic traces of tax haven operations, employees, web sites, contacts - We should not get exposed to our own Ethics code whisleblowing process ! Opacity is at its maximum, and no one knows who watches these subsidiaries !

Oracle Board Opposes Sustainability Proposal

Behind the scene, marketing stuff, green washing, the hard facts are very clear about Oracle's commitments regarding environmental responsability. Positive action is hardly ever taken, and there is still very few information regarding Oracle CO2 emissions and compensations.

The internal green programs seem to be there just as a tick-box for the responsability annual report, and would definitly benefit a more ambitious developpement under direct Board Control.

Corporate guidance is mandatory to move on, but we face a no-way.

Oracle sued for alleged fraud against US gov

Well, we had lots of concerns regarding the compliance and ethics code.
Seems we have our confirmation about the serious doubts of having real ethics or just just marketing sheets.

The complaint against Oracle was originally filed by an Oracle employee, who alleged that large discounts offered to other customers were hidden from government agencies.

Has there been any whisleblowing process ?
The inquiry will undoubtly give some informations.
Let's remind that a previous case was settled in 2006 over a 98 Millions USD deal, where the external whisleblower got 17 Millions USD through the false claim act...

And would'nt you want more clarity regarding haven islands Oracle operations ?

Sharing the code of ethics goals

The FR Works council is beeing consulted on the code of Ethics and Business Conduct to be implemented in France. This code should be fully enforceable towards employees.
The exposed principles are quite legitimate as they define what a responsible employee in a responsible company should do.



Responsible company ?
We face very opaque compliance protocols, as employee reps cannot control the ethics alerts nor allow any investigation rights on non compliances issues.
The company refuses to answer any questions regarding offshore operations, non compliance alerts.
Very strict SEC requierements are to be enforced to guarantee governance rules in terms of corruption, local law compliance, fair treatement and reporting.
We feel the lack of a World Wide Employee Works council independant control is a very important flaw, and we feel dangerous operations could still be conducted, "under the radar screen" in confined areas of huge corporations like Oracle.

Let's not forget Delaware, Cayman Islands, Mauritus, Luxembourg operations actually beeing run by Oracle - Who is in charge of controlling what's been done there ?
Are shareholders and employees to be proud of those covert operations ?

Pittsburgh G-20 Process Must Tackle Banking Secrecy, Illicit Financial Flows

Employee reps are constantly beeing refused access to informations regarding Oracle offshore operations.
We do support the "Global Financial Integrity" call to urge leaders to pursue measures to increase transparency in global finance and curtail illicit financial flows.
Why would there be such a secrecy, with autonomous computer networks not linked to the main Oracle Intranet, and impressive firewalls ?
Why would an honest company still need so many holdings in Haven Islands ?

We know for sure Oracle CAPAC is driving key operations to prevent country tax authorities to challenge zero or near zero withholing rates applied.
An other example, France Tax authorities are conducting a 6+ years revenue recognition review, challenging the operating cost transfer ratios used by the company.

It's time for an higher morale in Corporations !

Oracle & Offshore - No comment

Local Management refused to give any explaination regarding Cayman operations of Oracle. Theses operations are controlled outside employee representatives legal perimeters.
